1. Summary and recommendation. Americans are rethinking the criminal justice system through partisan, ideological, and ethnic lines. This is completely appropriate—and necessary. Despite this, many discussions, debates, and policy prescriptions on this subject are not based on solid evidence. Convoluted and often conflicting facts are often quoted, weakening attempts to improve a system that is broken in many ways. By placing decades-long crime and punishment patterns in relevant historical and comparative contexts, this chapter aims to provide people and policymakers—including the next president—with a structure for evaluating the opportunities and challenges of criminal justice reform. African Americans have been denied economic mobility by both legal and illegal means due to a long and violent history of discriminatory policies. While the post-Reconstruction period and Jim Crow policies resulted in brutal results for African Americans, Southern and national politicians' responses to the Civil Rights movement in the 1960s continued to support oppressive policies. For the last 50 years, this so-called Southern strategy has dominated conservative politics and policy, harming African Americans to this day. The issue that I shall discuss here is : Structural racism and barriers to prosperity.
